1. Eligibility: Gold Canyon Wish List Giveaway (the "Scratch Card Game") is open only to legal residents of the fifty (50) United States (and the District of Columbia) and Canada (excluding Quebec), who are at least eighteen (18) years old at the time of entry. Void in Quebec and where prohibited by law. Employees of Gold Canyon International, LLC, Ideas Collide, Inc., WS Packaging Group, Inc., ePrize, LLC, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state, provincial, municipal, territorial and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's and Administrator's decisions, which are final and binding in all matters related to the Scratch Card Game. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Scratch Card Game begins on September 1, 2010 and ends on November 30, 2010 (the "Promotion Period").

4. How to Enter: You will need to obtain a scratch-off game piece ("Game Piece") that will provide a discount on a future purchase, a special offer and/or instructions for claiming a prize in order to participate in the Scratch Card Game. There are two (2) ways to obtain a Game Piece:
  • a) Purchase Specially-Marked Products: During the Promotion Period and while supplies last, purchase a specially-marked diffuser and/or a 5.8 oz. diffuser refill in your choice of ten (10) different fragrances from a home party, Gold Canyon Demonstrator or online at www.goldcanyon.com. Each specially-marked product will include Game Piece.
  • b) Free Mail-In Method of Entry: To obtain a Game Piece without making a purchase, send a self-addressed stamped envelope to "Gold Canyon Wish List Giveaway," c/o ePrize, LLC, P.O. Box 5927, Kalamazoo, MI 49003-5927. Residents of Vermont and Canada may exclude return postage. While supplies last, Sponsor will mail one (1) Game Piece per envelope. All mail-in entries must be handwritten, postmarked by December 1, 2010 and received by December 7, 2010. Use of any automated system to participate is prohibited and will result in disqualification. All requests become the exclusive property of Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due requests, which will be disqualified. You will receive the requested Game Piece, while supplies last, approximately one (1) week after Sponsor's receipt of your request.

    Once you have obtained a Game Piece, scratch the surface to see if you are a potential instant winner of a prize. If you receive a winning message, you are the potential winner of the prize indicated.
5. Prize Claim Instructions (Read Carefully): Each potential winner must redeem his or her prize by following instructions on the back of the Game Piece, terms and conditions apply. Winner must provide the information requested on the back of the Game Piece (full name, date of birth, full mailing address (no PO Boxes), valid email address and phone number) and send it, along with the original Game Piece, in an envelope with proper postage addressed to "Gold Canyon Wish List Giveaway-Prize Claim," c/o ePrize Fulfillment Services, P.O. Box 5886, Kalamazoo, MI 49003-5886. Potential winner should retain a photocopy of his/her winning Game Piece and information provided. Prize claims must be postmarked by December 21, 2010, and received by December 29, 2010. If claim is not postmarked and received on time, or if prize is returned as undeliverable, potential winner forfeits the prize, which will remain un-awarded.

Before fulfilling prizes, Sponsor will verify all submitted Game Pieces. A Game Piece is invalid and will be rejected if: (a) it has been tampered with in any way; (b) it has been counterfeited or reproduced, in whole or in part; (c) it has been obtained where the Scratch Card Game is prohibited; (d) it has been obtained outside of authorized channels; (e) it is damaged or mutilated; or (f) it contains any printing, production, typographical, mechanical, seeding or other errors. You have not won any prize until (a) your Game Piece and (b) your compliance with these Official Rules have been verified. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Scratch Card Game materials submitted to Sponsor. All materials submitted become property of Sponsor and will not be returned. Winners must comply with all terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements.

If any potential winner is a Canadian resident, he/she will be required to answer a time-limited, skill-testing question without assistance, in order to be eligible to receive a prize. If a Canadian potential winner fails to answer the skill-testing question correctly, potential winner forfeits the prize. The question will be administered via email so email address provided by potential winner must be valid or he/she will forfeit the prize.

Verified winners will receive the prize indicated on Game Piece within approximately 8-10 weeks after the conclusion of the Scratch Card Game.

  • Ten (10) $250 Gold Canyon Shopping Spree Vouchers: ARV: $250 USD. Odds of winning this prize are 10:50,000;
  • Thirty (30) $100 Gold Canyon Shopping Spree Vouchers: ARV: $100 USD. Odds of winning this prize are 30:50,000;

The ARV of electronic prizes is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Terms and conditions of gift card and shopping spree voucher prizes apply.

For All Prizes: Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

Total ARV for all prizes: $ 20,674 USD.

7. Release: By receipt of any prize, each winner agrees to release and hold harmless Sponsor, Ideas Collide, Inc., WS Packaging Group, Inc., Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Scratch Card Game or receipt or use or misuse of any prize.

8. Publicity: Except where prohibited, participation in the Scratch Card Game constitutes each winner's consent to Sponsor's and its agents' use of winner's name, likeness, prize, photograph, voice, opinions and/or hometown and state or province for promotional purposes in any media, worldwide, without further payment or consideration.

9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Scratch Card Game, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Scratch Card Game, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Scratch Card Game or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Scratch Card Game may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Scratch Card Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Scratch Card Game; (4) technical or human error which may occur in the administration of the Scratch Card Game or the processing of prize claims; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Scratch Card Game or receipt or use or misuse of any prize. Sponsor's liability for Game Pieces containing printing or other errors is limited to replacement with another eligible Game Piece, while supplies last. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Scratch Card Game or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Scratch Card Game, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Scratch Card Game, shall be governed by, and construed in accordance with, the laws of the State of Michigan, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan, U.S.A.
